Proofing & Print Authorization Liability -
Regardless of who writes the content or where it came from,
when proofing you are responsible for: Spelling &
Grammatical Accuracy, Industry Content Accuracy and
whatever is Lawfully Acceptable for Your Industry.
I will of course do my best to notice errors or offer advice
wherever I see the opportunity to do so, but the post printing
liability is yours if, what you approved, is what you receive.
If I print something that is not what you authorized to print or
there is reasonable physical defect, then I will pay to correct
the problem if you need me to. If however you have to pay, I
will give my prices to help offset the expense.
2) Color
Matching –
There is
a 3% - 5% variance in color tones from one print job to the
next, even when ordering the same template. Factory inks and
toners vary from print job to print job and there is a
difference between what your monitor thinks is “blue” for
instance, and my monitor thinks is blue. If strict color
matching is crucial, there are two steps you can request.
Pantone Matching –
This is
not the most sure way, but it is certainly a lot more certain
than proofing from your monitor alone. This is where you and I
sit down with a Pantone Color book and literally pick out your
colors. Then I make sure the colors within your template are
the same.
Printed Proofs –
The most accurate method is to order a printed proof. The cost
is between $15-$25 (normally) and this is where the factory
mails a printed example of your order. This causes delays as we
must wait for the proof to get back before placing the main
order. However, this can be done if color matching is that
important to you. Otherwise, you accept that there may be a
slight difference in color tone when you receive your order.
Note:
Less than 1 out of 100 customers ever order a printed proof and
less than 3 out of a 100 ever complain about the color or the
print job.
3)
Ordering, Payment & Refunds –
After you
determine your order, I will send you an invoice. Payment must
be received before design work or printing can be done on your
order. “How do I know if I will like the work and still want
to order?” That’s a risk you are going to have to take! If
you like what I have done for others, the chances are pretty
good you will like what I do for you too.
Important Note:
Just don’t compare work I do for a 1-2 hour job
to work done for a $2,000 branding client!
Refunds –
Once
payment for a job has been received, there’s a $25 processing
fee (plus finance charges, if any) for issuing a refund on a job
cancellation, IF the job was cancelled before labor has
been provided. If the cancellation comes after work has been
started, only printing monies can be refunded (minus the
processing fee). However, there are no refunds for design
rejection. I will do my best to make you happy, but you can't
refund the time I spent and I can’t refund your money. This is
a very common design industry policy and a good reason why
customers should make sure they like the designer’s work and
style before ordering work.
4) Intellectual Property Ownership
Rights –
If you are choosing one of my
pre-designed concepts, whatever add-ons or changes I design for
your order may also become work I resell in the future. This is
true even if you supplied me with the ideas, unless we agreed in
writing to the contrary or I charge you for the design work.
If you are paying me to custom
design your order, then I will not use your designs for anything
beyond displaying samples of the work in my own promotions. If
however, I do not charge you for custom design work, then I
retain the ownership of whatever is designed and will use as
intellectual property at my own discretion (unless we agree to
otherwise in writing). If you ever have any questions regarding
this or any policy, please ask.

Delayed Project Penalties –
My prices
are based on the assumption that I will be able to complete your
order in a reasonable amount of time and move on to the next
job. Sometimes, a client can prevent that from happening
and can do so by one or more of the following ways:
• Failing
to submit required payment, materials or information
• Not responding to proof requests or requests for feedback
• A general disinterest in the status or progress of their
project (for whatever reason)
When this
happens, I can cause me to fail to complete the project by the
target end date and jobs begin to pile up. This means I
have to work on weekends and over-time to get your project done
while meeting the demand of the new projects I have to sell to
remain in business. When and if this happens, I will have
to charge a delay fee.
Target
End-Date Policy - which is based on the
maximum projected turn-around time (in calendar days) divided by
the price of the project. This rate is then charged for each
business day the project is delayed beyond the maximum projected
turn-around time (in calendar days) until 50% of the total
project price or ($250), whichever is less, is reached. At this
time, I may refuse to complete the project and any monies paid
will be forfeit. Of course, I retain the right to judge
mitigating circumstances and make decisions in the client’s
favor at my own discretion.
Target End Date Policy -
If I have been steadily providing progress but the project is
unfinished because of client-caused delays, then the final
payment will be due regardless of project status and delay fees
may begin to be added on.
This delay fee is a pro-rate calculated by the number of days
committed to the project divided by the project price.
This rate is charged for each business day the project is
delayed beyond the target end date until 50% of the total
project price or $250 is reached (whichever is less).
If the maximum penalty is reached, I will ask for all monies to
be paid (including penalties) and I will give a time deadline
based on the percentage of the project left undone times the
total days originally committed to the project. If this
time is passed and I am still unable to complete the project,
the project agreement will be considered breached and all monies
paid will be forfeit.
Of course, I retain the right to judge mitigating circumstances
and make decisions in the client’s favor at my own discretion.
Default Turn-Around Times -
For the purposes of this policy, unless stated otherwise, that
commitment period is 2-3 business days for single print
templates, 1-2 weeks for custom design jobs under $1,000 or 4-6
weeks for identity branding projects or design jobs over $1,000.
6) Email
“Ball in Court” Communication Policy –
During
business hours, I am committed exclusively to Blackstone Realty
and therefore work on projects after-hours and over the
weekends. Due to my unusual design hours, I cannot always
contact clients on the phone to ask for what I need or to alert
them about incoming email proofs. In other words, I rely a lot
on email as my predominate form of communication. If you have
trouble with checking email regularly while we are in a project
together, please let me know. Otherwise, the following policy
must apply to you:
Unless I
forget, I will send certified emails so I can know that you
received the email (as emails don’t always successfully
transmit). If I don’t receive a response, I will try to phone
you during business hours to inform you directly (or by
voicemail) that I sent an email. If you didn’t receive this
email, since there may be a problem between our email
technologies, you need to let me know by calling my direct
number (909.319.3320).
7) Rules
for Stock Images in Your Artwork –
I often
use stock images purchased off websites like "IStockphoto.com"
in order to illustrate and/or add decor to a design. You
are not free to use these photos for any purpose outside of the
original document they were designed for and only for your own
use. You need an extended license to be able to use stock
photos in products intended for resale. Therefore, before
you make cups, t-shirts or any other product, if it has photos
or images that didn't come from you, please check with us first.

Website Design Policy – I design
websites, but I have the websites programmed by Sam Lawrence of
TechnologySquared.com.
I charge for
programming fees upfront with every website job, however, once
the design has been approved for programming, future changes
that result in additional fees will be passed on to the client
(you). Furthermore, I only recommend Technology Squared
for hosting, I receive no consideration other than the
satisfaction that comes from referring. However, you are
free to have your website hosted wherever you prefer. I
just like having someone that knows what they're doing actually
answer the phone when I call and for my clients that agree...
they host with Tech Squared. |
