Advantages of
Hourly: Since we
also offer discount pricing with our hourly pre-paid choices,
customers can enjoy package discounts without having to commit
to the whole package. This option also allows customers to
go as fast or as slow as they want and can incrementally
complete
large design projects like a company branding package.
Furthermore, it's possible, though not guaranteed, to end up paying less
than the package price. However, when this happens it is
usually due to the rapid nature of clients who know they are
being charged by the hour (and not because our packages are
over-priced).
Disadvantages of Hourly: We cannot guarantee that we will
complete a project within the same time the package price might
suggest. In addition, some clients have the tendency to
want to rush the design process and that can have obvious
consequences. Along the same lines, approaching a large
project, like a branding package, through the hourly option
often results in stop-n-go progress. This is not the
optimal scenario for the creative process as inspiration is at
its highest when allowed to function without interruptions.
Since the results for a successful design project can
potentially be unimaginable, we recommend paying the package
price whenever possible to avoid any of these possible
disadvantages.
Pre-Paid Hourly Terms
We do not
guarantee the amount of hours a project will take (unless stated
in writing) and any additional material expenses like; stock
photos, domain name registration, website hosting and/or any
material expense outside of design labor (including IT labor),
is an additional expense paid for by the client (unless
stated otherwise in writing).
Client Liability for Submitted
Material: Clients hold RightPros
and anyone contracted by RightPros or affiliated with RightPros, free of any liability that
may result from using any intellectual property (IP) or copy written
material or
otherwise legally protected material that is submitted to
RightPros by the client or representative of the client, for use
in any project RightPros is hired to create, print, design or
develop.
Project Updates:
In order to offer clients as much control in the direction of
the project as possible, we routinely update the client
and/or submit as many proofs as is reasonable within the
pre-paid time. When pre-paid hours have been used, we
will pause the project, update the client on the status and
provide an estimate of hours remaining. The client may
take as long as they want to resume the project and are free to
end the project at any time.
Refund Policy:
No refunds can be
given for any reason (unless determined otherwise by RightPros).
Unused Pre-Paid
Hours:
While we cannot refund unused hours, we will add 20% to the
hours remaining in the form of a company credit that can be used
towards any future RightPros labor services and will remain
useable for up to one year from the date the credit was issued.
Design
Release:
At the client's request or at the end of the project, RightPros
will provide a CD containing only the approved design files.
In the event the client stops the project before completion and
there were multiple compositions produced for a single project,
the client can only choose one the concept per item to be placed
on the Design Release CD. Rejected concepts remain the
intellectual property of RightPros.
Ancillary Intellectual
Property Rights (AIP):
Are the rights to re-use or re-sell or make other products from
the original design. When paying the non IP hourly rate,
the client is only allowed to use the design for the purpose it
was created (i.e., a business card, website or brochure).
If clients want the freedom to completely own what is designed
they have one of two options:

Exercise the Full IP Release Option for $500 - If a client
later discovers that a design we created is something they want
to own the full rights to, we will honor this purchase option
without question.
• Purchase a Branding Design Package - We release the
full AIP rights as part of the package.
Exceptions:
When
we are hired to create extensions to existing branding or design
schemes already owned by the client we exercise no rights to the
designs produced. We release the full rights to any logos
we are hired to design.
Why Do We Do This:
Our branding package pricing is partly based on the
understanding that we will be releasing the full rights to our
creative inventions. Most design firms do not release
these rights at any price. This is our livelyhood and the
result of years of dedication to our craft. If we were
hired to create a business card, per say, because of the years
of sacrifice and dedication to our creative talents, we might
invent something quite remarkable. It would not be right
then to release the creative work for two hours of design fees.
We also do not want to withhold our full creative capabilities
from our clients either.
People
that are specifically looking for branding or prolific creative
designs should not seek to obtain them in a minor project like a
business card (unless exercising their purchase option is a
secondary option). If we are hired to create a single
template, the exclusive rights to use that template should then
be sufficient. |
